If the house is worth $500,000, the probate will cost more than $13,000, and likely take a year or longer to complete. And since the probate fees are based on the gross value of assets rather than the net value, if that $500,000 house has a $490,000 mortgage on it, the probate fees will be based on the $500,000, not the $10,000 of equity. This wasted time and money going to court could have been avoided if Joe and Wendy simply had put their assets into a living Trust.
